WHO CAN PARTICIPATE IN JURY DUTY IN CHARLOTTE COUNTY?
Qualified jurors must be 18 years old, resident of
Florida and possess a valid drivers license or identification card issued
by the Department of Highway Safety and Motor Vehicles.
HOW ARE JURORS DETERMINED?
In January of
every year, the Department of Highway Safety & Motor Vehicles
provides the Jury Division of the Charlotte County Clerk of the
Circuit Court, a database list of driver’s license and
identification card holders residing in the county. Whenever a
venire is drawn, (which is a list of prospective Jurors), the Clerk of
Courts will initiate the computer selection. The computer will begin
the process of randomly selecting jurors using the Random Number
Generator Formula recommended and certified by the Florida Supreme
Court, omitting the names of persons who a) have been convicted of a
felony and not had their civil rights restored; b) are deceased
according to the records furnished by the Department of Health and
Rehabilitative Services; c) have been adjudicated mentally
incompetent or permanently excused by the presiding administrative
judge; or d) have reported as a prospective juror in Charlotte
County within one year before the first day for which the person is
being considered for jury service. The process will repeat until the
number of jurors requested has been selected. Those individuals
selected are then “summoned” by mail. The “summons” contains
instructions to determine when, where and if an individual is to
report.
NOTE: If you
receive a jury summons but were not called upon to report for
service, you may be randomly selected again at any time. However, if
you are instructed to report, and you appeared for jury duty, you
will be exempt for one year from the last date of your service.
WHAT IF I FAIL
TO REPORT TO JURY DUTY?
If you are summoned to report and you fail to attend
without being properly excused, you can be fined up to $100 as well
as be held in contempt of court.
