Chapter 83 of the Florida Statutes provides the
necessary steps to follow in an eviction case. These books are
available to the public for review Monday through Friday from 8:00
a.m. until 5:00 p.m. in the Law Library located on the first floor
of the Charlotte County Justice Center in Punta Gorda. You may also
find information concerning evictions in the Florida Residential
Landlord Tenant Manual, which may be obtained through Court
Administration located on the second floor of the Charlotte County
Justice Center.
The filing fee for a tenant eviction is $185.00 and
can be paid either by cash, money order or check. If paying by
check, please make said payable to the Clerk of the Circuit Court.
Please note that there is an additional fee of $10.00 to issue each summons.
The Sheriff's Department will serve the summons for a fee of $40.00
per tenant. Said check or money order should be made
payable to the Charlotte County Sheriff's Department.
Please note that the Clerk cannot provide you with
the forms needed to file Landlord/Tenant cases nor can she assist in
the completion of said forms.
A Tenant Eviction kit may be purchased from an office
supply store or can be obtained from an attorney. If you have any
questions or if you are experiencing difficulty with a particular
case, you may find it necessary to consult an attorney as the Clerk
is prohibited from giving legal advice. |
